Does the establishment of a permanent InternationalWar Crimes Tribunal (International Criminal Court - ICC) constitute a challenge to national sovereignty? According to previous US governments and several American observers, the answer is yes. Establishing a world court that acts independently of the states that gave birth to it renders the idea of sovereignty meaningless. This article analyzes the American objections to the ICC and the conception of sovereignty and international law underlying these objections. It first considers the structure and intent (...) behind the criminal court and attempts to unveil the logic hiding behind the idea of ‘America’s historical uniqueness.’ It touches on the diverging US and European conceptions of sovereignty and ends up arguing that governments that stick to traditional conceptions of sovereignty and international law in the employment of their foreign policy may lose the moral legitimacy that has proven increasingly important for winning the sympathy of allies and regaining world leadership. This book represents emerging alternative perspectives to the "constructivist" orthodoxy that currently dominates the field of science and technology studies. Various contributions from distinguished Americans and Europeans in the field, provide arguments and evidence that it is not enough simply to say that science is "socially situated." Controversial Science focuses on important political, ethical, and broadly normative considerations that have yet to be given their due, but which point to a more realistic and critical perspective on science policy.

Suppose Manuel and Jimena are suffering from an equally painful migraine. Unlike Jimena, however, Manuel will undergo fission. Assuming you have a spare painkiller, whom should you give it to? Intuitively, you have no more reason to give it to one or the other. The problem is that the cohabitation account suggests (...) otherwise. According to the account, there are two persons cohabiting Manuel’s body, in which case you should arguably give them the pill, since doing so alleviates the pain of more beings. One response argues that the two persons cohabiting Manuel’s body share one pain. Thus, giving them the pill alleviates no more pain than giving it to Jimena, and therefore you have no more reason to do one or the other. Childhood obesity has become a public health epidemic, and currently a battle exists over how to frame and address this problem. This paper explores how public policy approaches can be employed to address obesity. We present the argument that obesity should be viewed as the consequence of a “toxic environment” rather than the result of the population failing to take enough “personal responsibility.” In order to make progress in decreasing the prevalence of obesity, we must shift our view of obesity (...) away from the medical model to a public health model . At the same time, we must be sensitive to the problem of weight bias.Potential obstacles to taking a public policy approach are identified, as well as suggestions on how to overcome them. (shrink)

After years of near total neglect, the problem of childhood obesity is now in the limelight. Terms like “epidemic,” “crisis,” and “emergency” are used frequently when describing the trend. Progress is defined with strong language and fueled by statistics such as the observation that this generation of children will be the first to live shorter lives than their parents. Multi-disciplinary journals such as the Journal of Law, Medicine & Ethics have dedicated symposiums to the issue, and conferences have been convened (...) not only by health professionals but by government agencies, the food industry, and even professionals who market to children. The seriousness of childhood obesity is no longer in doubt, and finally attention has turned to the more complex question – what must be done? (shrink)

Jonathan Schaffer has provided three putative counterexamples to the transitivity of grounding, and has argued that a contrastive treatment of grounding is able to provide a resolution to them, which in turn provides some motivation for accepting such a treatment. In this article, I argue that one of these cases can easily be turned into a putative counterexample to a principle which Schaffer calls differential transitivity. Since Schaffer's proposed resolution rests on this principle, this presents a dilemma for the contrastivist: (...) either he dismisses the third case, which weakens the motivation for accepting his treatment of grounding, or else he accepts it, in which case he is faced with a counterexample to a principle that his proposed resolution to the original cases depends on. In the remainder of the article, I argue that the prima facie most promising strategy the contrastivist could take, which is to place some restriction on which contrastive facts are admissible so as to rule out the purported counterexample to differential transitivity, faces some important difficulties. Although these difficulties are not insurmountable, they do pose a substantial challenge for the contrastivist. (shrink)

Kris McDaniel has recently defended a criterion for being an ontological pluralist that classifies the quantifier variantist as one. In this paper, I argue that this is a mistake. There is an important difference between the two views, which is sometimes obscured by a common view in the metaphysics of fundamentality. According to the simple analysis, a language is ideal—it allows for a maximally metaphysically perspicuous description of reality—just in case all its primitives are perfectly natural. I argue that this (...) analysis struggles to distinguish quantifier variance from ontological pluralism, and then I discuss various accounts that can do better. I then propose a criterion for being an ontological pluralist that does not misclassify the quantifier variantist. Finally, I discuss some additional advantages of my proposal. (shrink)

How veridical is perception? Rather than representing objects as they actually exist in the world, might perception instead represent objects only in terms of the utility they offer to an observer? Previous work employed evolutionary modeling to show that under certain assumptions, natural selection favors such “strict‐interface” perceptual systems. This view has fueled considerable debate, but we think that discussions so far have failed to consider the implications of two critical aspects of perception. First, while existing models have explored single (...) utility functions, perception will often serve multiple largely independent goals. (Sometimes when looking at a stick you want to know how appropriate it would be as kindling for a campfire, and other times you want to know how appropriate it would be as a weapon for self‐defense.) Second, perception often operates in an inflexible, automatic manner—proving “impenetrable” to shifting higher‐level goals. (When your goal shifts from “burning” to “fighting,” your visual experience does not dramatically transform.) These two points have important implications for the veridicality of perception. In particular, as the need for flexible goals increases, inflexible perceptual systems must become more veridical. We support this position by providing evidence from evolutionary simulations that as the number of independent utility functions increases, the distinction between “interface” and “veridical” perceptual systems dissolves. Although natural selection evaluates perceptual systems only on their fitness, the most fit perceptual systems may nevertheless represent the world as it is. (shrink)

Historical and Theological Reflections, Matthew Levering writes "to make the case" that there is "good reason" to believe in the bodily resurrection of Jesus (1). In this (...) self-described work of "theological apologetics" (211), Levering argues from a threefold foundation for the credibility of Jesus's resurrection: (1) "the New Testament evidence," considered from the perspective of historical investigation; (2) the "sheer strangeness" of the apostolic claim that [End Page 1347] Jesus was "resurrected" and not just resuscitated or exalted into heaven as an immortal soul; (3) and the intrinsic credibility of the "supreme love" revealed through his death and resurrection (2–4). As this threefold foundation makes clear, Levering draws together both "historical and theological reasons for believing that Jesus' Resurrection happened" (4).In chapter 1, Levering contends that, while "faith does not stand or fall upon the results of historical research, those who insist that the truth of Jesus' Resurrection has nothing to do with the domain of historical investigation are mistaken" (30). To this end, he offers a survey of three figures: (1) the Belgian Dominican theologian Edward Schillebeeckx; (2) the American Protestant biblical scholar Dale C. Allison Jr.; and (3) the Anglican bishop and biblical theologian N. T. Wright. Levering exposes the serious flaws of contemporary attempts to reduce the resurrection claims of early Christians to hallucinations or visions of someone who has recently died. In particular, Levering finds compelling Wright's argument that the bodily resurrection of Jesus provides "the best historical explanation" of the early Christian claim that what first-century Jews expected to happen to everyone at the end of time had in fact happened to only one person—Jesus of Nazareth—in the middle of time. On receiver-based teleosemantic theories of representation, the chemical states of the circadian clocks in animal, plant and cyanobacterial cells constitute signals of future states of affairs, often the rising and setting of the sun. This signalling is much more rigid than sophisticated representational systems like human language, but it is not simple on all dimensions. In most organisms the clock regulates many different circadian rhythms. The process of entrainment ensures that the mapping between chemical states of the clock and the (...) daily light-dark cycle is adjusted to deal with seasonal changes. In regulating anticipatory behaviour, the states of the clock look forward both to the time the behaviour is supposed to happen and the later time when the anticipated circumstances are supposed to arise. The case of the circadian clock shows that purely indicative signals can arise in very basic biological systems and brings into sharp relief the trade-offs involved in characterizing representational systems. On receiver-based teleosemantic theories, future-directed signals are not restricted to complex multicellular organisms but are ubiquitous in the biological world. (shrink)

El presente artículo es un estudio comparativo donde se argumenta la relación disonante entre las obras de Schmitt y Benjamin sobre la estética barroca. Se defiende que la diferencia entre ambos consiste en su concepción de lo político. Para Benjamin, son dos los aspectos fundamentales del Trauerspiel alemán: 1) la diferencia entre drama barroco y tragedia clásica y 2) el recurso a la alegoría como técnica de expresión. Schmitt, por su parte, encuentra lo singular del drama barroco en la irrupción (...) del tiempo histórico-político dentro de la forma estética. Para el crítico berlinés, lo alegórico debe estudiarse desde la filosofía de la historia, mientras que para Schmitt lo decisivo es lo político, ejecutado a través de la soberanía y la decisión. Tal es la línea argumental del presente estudio. This paper is a comparative study about the Works of Benjamin and Schmitt on the baroque art. It argues that the specific difference between them most be found in their concept of the political. For Benjamin there is a difference between tragedy and drama, the german Trauerspiel it is an allegorical approach to thingsand history. Schmitt argues that the singularity of baroque drama is the irruption of time in the plastic form. These are the points that the paper proposes. (shrink)

For a Better Worldliness is not only a statement of Abraham Kuyper's and Dietrich Bonhoeffer's theological concept and historical practice of discipleship. It is also--and perhaps more importantly--a call to engage in the fullness of the Christian life here and now. While this book goes to great efforts to establish sound historical and theological insights specifically in regards to Kuyper and Bonhoeffer, there is a strong underlying current that these particular insights deeply matter to the life of discipleship in the (...) world today. History shows us that discipleship is not a singular journey; because of Jesus Christ it is not a description of one set path with one set of guidelines. A disciple can be a prime minister who unabashedly and successfully campaigned on his Calvinistic principles, just as he can be a participant in a coup d'état launched against a tyrant, leading to the disciple's own imprisonment and death. This study conducted life story interviews with 40 members of the PRSA College of Fellows to examine the influence of crucibles (i.e. trials, challenges or growth opportunities) in the moral development and psychology of public relations exemplars. The outcomes were the development of an illustration of their moral and leader development journey drawing on Rest’s four-component model of ethical decision making, and a moral psychology profile of the key characteristics of public relations exemplars. The profile that emerged is that of (...) leaders who exemplify moral courage, resilience, generosity, genuine care about others and are willing to listen and learn. When they faced trials, they emerged stronger and stayed true to their values and character. (shrink)

Alternative food networks are exemplified by organic, fair trade and local foods, and promote forms of food provisioning that are ‘corrective’ to conventional agriculture and food systems. Despite enthusiasm for AFNs, scholars have increasingly interrogated whether inequalities are perpetuated by AFNs. Reproduction of gender inequality in AFNs, particularly at the level of consumption, has often been left empirically unexamined, however. This is problematic given that women continue to be predominantly responsible for food provisioning in the US, and that this responsibility (...) can lead to negative physical, psychological and social outcomes. Using quantitative methods and data from the 2012 Ohio Survey of Food, Agriculture, and Environmental Issues, this paper examines the extent to which gender inequality in the division of labor is reproduced in AFNs by focusing on the potential persistence of gender inequality in food provisioning among AFN participants. Findings suggest that among AFN participants, particularly those utilizing local food systems, women, compared to men, remain predominantly responsible for food provisioning, spend more time in food provisioning, and engage in more food provisioning from scratch. This research confirms that food provisioning remains a gendered act amongst AFN participants, calling attention to the persistence of gender inequality in AFNs. The paper concludes by suggesting that AFNs are positioned as a place to create change, albeit small scale, in the gendered division of household labor in the US, and provides some practical suggestions for how this might occur. In recent years, calls for philosophy to interact more with the public have grown louder in the German-speaking world as well as elsewhere. Public philosophy, as it were, has a long-standing tradition, reaching back to Enlightenment-era German “Popularphilosophie” and of course to Socrates and the Sophists. This section presents four short articles on some current aspects of the public-philosophy debate: on the overall conditions for transferring content from academic philosophy to the public in Germany; on the relations between philosophers’ mediatic (...) presence and their disciplinary expertise; on 18th-century guidelines for accessible philosophical writing; and on public philosophy as a social practice that is more than mere unidirectional knowledge transfer. Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. This paper explores the relationship between people's mental imagery for their experiences of paths and roads and the metaphorical use of path and road in discourse. We report the results of two studies, one a survey examining people's mental imagery about their embodied experiences with paths and roads, with the second providing a corpus analysis of the ways path and road are metaphorically used in discourse. Our hypothesis is that both people's mental imagery for path and road, and speakers' use (...) of these words in metaphorical contexts are strongly guided by their embodied understandings of real-world events related to travel on paths and roads. The results of these studies demonstrate how bodily experiences with artifacts partly constrains not only how specific conceptual metaphors emerge, but how different metaphorical understandings are applied in talk about abstract entities and events. ‘Culturology’ is an integral, often compulsory, part of Russian university courses; the discipline has largely replaced chairs in Marxist-Leninism and dialectical materialism, and bookshops are full of texts on the subject. This article is based on analysis of more than ten university textbooks recommended to first-year students. Marlène Laruelle examines why culturology has become so important, the place claimed for it within the human sciences, and what it means for changing Russian ideas of identity and nation.

La presente investigación surge como parte del análisis para la creación de políticas de ecoeficiencia en las empresas y tiene como finalidad el conocer las buenas prácticas ambientales aplicadas por las empresas del sector servicios en la ciudad de Girardot. Se presenta como un estudio descriptivo-analítico con enfoque cualitativo, utilizando como instrumento la ficha de observación aplicada a una muestra de 30 empresas del sector de servicios. Dentro de los resultados obtenidos se encuentra la calificación de acuerdo con un puntaje (...) entre 0.0 y 1.0 y el análisis del resultado total con ponderación de 0% a 100% a 11 criterios evaluados. Legal analysis is a task underlying many forms of legal problem solving. In the Anglo-American legal system, legal analysis is based in part on legal precedents, previously decided cases. This paper describes a reduction-graph model of legal precedents that accounts for a key characteristic of legal precedents: a precedent's relevance to subsequent cases is determined by the theory under which the precedent is decided. This paper identifies the implementation requirements for legal analysis using the reduction-graph model of legal precedents and (...) describes GREBE, a program that satisfies these requirements. Traditionally, ontology, or at least western ontology, bas been an anthropocentric enterprise, that takes only human experiences into account. In this paper I argue that a prolific biocentric ontology can be based on UexkülI's Umwelt theory. UexkülI offers the basis of an ontology according to which the study of experiences is a much wider field than it is as depicted by classical ontology and contemporary philosophy of consciousness. Based on the thoughts of the contemporary philosopher Thomas Nagel I claim that (...) there might very well be Iifeforms that are totally unimaginable to us. I argue that this view is compatible with the Umwelt theory, and that it should be adopted by biosemioticians. Furthermore, I argue that a biosemiotic possibilism should be implemented. Followingly, one should not claim to know which characteristics of living beings are universally and necessarily valid, but restrict oneself to statements about life as we know it. (shrink)

Logic-based approaches to legal problem solving model the rule-governed nature of legal argumentation, justification, and other legal discourse but suffer from two key obstacles: the absence of efficient, scalable techniques for creating authoritative representations of legal texts as logical expressions; and the difficulty of evaluating legal terms and concepts in terms of the language of ordinary discourse. Data-centric techniques can be used to finesse the challenges of formalizing legal rules and matching legal predicates with the language of ordinary parlance by (...) exploiting knowledge latent in legal corpora. However, these techniques typically are opaque and unable to support the rule-governed discourse needed for persuasive argumentation and justification. This paper distinguishes representative legal tasks to which each approach appears to be particularly well suited and proposes a hybrid model that exploits the complementarity of each. (shrink)

Scholars have long asserted that public relations (PR) professionals should play the role of organizational conscience, but little research has focused on why and how they play this role effectively. We found that PR professionals who played the role of organizational conscience had broadened conceptions of their roles and responsibilities, including a fervent duty to the public interest. This often put them in the position of providing criticism to powerful organizational players. Rather than raising their ethical concerns as persuasive orators, (...) they used subtle, resourceful, and experiential approaches to persuasion. Playing the role of organizational conscience typically necessitated gaining access to informal coalitions since access to dominant power coalitions often was limited or late. Organizations with participative cultures supported the role of organizational conscience. (shrink)
